If you are intending to participate in Tearfund’s Drumlanrig Cycle Challenge event (‘the Event’), please read this document carefully. It is a condition of entry that you (referred to as ‘the Participant’ or ‘You’ in these Terms and Conditions) read and agree to the conditions below..

The Entry Terms and Conditions are a requirement of the event insurance:-

1. Health and Fitness

a. The Event is physical and may be strenuous in parts. The Participant must ensure that they are sufficiently fit and healthy to participate in the event safely.

b. Participants who have any doubt about their health or have a medical condition that could be affected by exercise, particularly a heart condition, epilepsy or asthma must have a medical certificate from their doctor stating that they are medically able to take part in the Event before participating. Please bring this with you and present to Annie's Aiders team or other external first aid supervisors who will be present for the duration of the event.

c. By agreeing to these Terms and Conditions, the Participant confirms that they take full responsibility that they are sufficiently fit and healthy to safely participate in the Event and for their personal well-being.

d. The Participant must be aged 14 years on or before the day the Event takes place, Saturday 24th August 2024. The Participant must bring along a form of identification on the day. All 14-17 year olds must have signed parental consent AND a parent or legal guardian accompanying them at all times on the Drumlanrig Cycle Challenge. The parent or legal guardian will need to sign in with them at registration.

2. Safety

a. The Participant takes part in the Event at their own risk. They will provide their own road bike and ensure a helmet is worn at all times. You will not be able to participate in the event without a helmet.

b. The Participant acknowledges and agrees that Tearfund’s Drumlanrig Cycle Challenge is a dangerous activity. Whilst Tearfund shall take steps to ensure that the Event takes place in a safe manner, the Participant acknowledges and agrees that as the Event takes place in public spaces, Tearfund cannot be held liable for any damage caused outside of its direct control.

c. The Participant acknowledges and agrees that there are risks associated with cycling events including falls, contact and/or collision with pedestrians & other riders, vehicles, the effect of weather including heat and/or humidity, the condition of the roads, and possibly the serious physical and/or mental trauma or other injury associated with cycling events and the Participant is taking part at their own risk.

d. The Participant must observe the road and traffic rules of Scotland. All cyclists in a group must ride in an orderly manner in accordance with the law relating to road travel, not more than two abreast, and extend all reasonable courtesy to other road users. This challenge is not a competition/race and there is no minimum speed which riders are required to cycle at. You must be considerate that cyclists of all levels may be participating.

e. The Participant acknowledges and understands the dangers associated with the consumption of alcohol and/or drugs before, during and after the Event and understands this may impair judgement and motor skills. By participating in this event, you confirm that you will not consume alcohol and/or drugs before or during the event.

f. It is advised that all riders must carry a form of identification showing their name, address and contact details of person to be advised in the eventuality of an accident. It is also advised that the Participant carry enough food, drink, money, mobile phone, spare inner tubes and a working pump, as well as extra clothing to complete the ride being undertaken, taking into account the route and possible adverse weather conditions. Organisers will endeavour to provide fluid and some form of food at designated "feed zones" however we cannot guarantee supplies will be available at all times and urge riders to be mindful of the needs of those following behind. Additionally these “feed zones” will have trash bags where you can dispose of empty bottles, wrappers etc. Please give the environment the respect it deserves.

g. There will be marshals wearing additional high vis clothing located at certain points on the route. All volunteers and staff involved in the Event will be clearly identifiable. The marshals do not have the authority to stop motorists; they are there to indicate direction and be a visible presence on the course. It is the responsibility of each participant to take the correct course and ensure that any movement is safe.

h. The Participant may not use your mobile phone while riding. You must stop at the side of the road if you need to make or receive a call.

i. A Broom Wagon will follow the event. All cyclists overtaken by this vehicle, and who are unlikely to finish before the close of the day will be given the option to either get in the vehicle, or to go on without the support which the event can offer, and at their own risk. Individual support cars are strictly forbidden; any participants seen to use one will be taken out of the event and disqualified.

j. The use of triathlon handlebars is discouraged in such events. However, where riders do have them fitted they are not to ride two abreast.

3. Liability and Insurance

The event public liability insurance covers only the organising team and the event volunteers, individual riders are advised to arrange their own cover for third party liability and/ or personal accident insurance to meet their needs.

Neither the promoter, the promoting organisation, Tearfund, or a member of the promoting organisation shall be liable for:

a. Any injury or accident causing loss or damage to you where this is sustained as a result of you taking part in the Event save where this is a direct result of the actions or negligence of the promoter, promoting organisation, Tearfund, or a member of the promoting organisation; or

b. Any loss or damage sustained by you as a result of the cancellation of the Event by the promoter e.g hotel bookings, for any reason including changes made to the Event by the promoter for safety or any other reasons; or circumstances beyond the control of the promoter.

c. If the participant decides to drop out of the event for whatever reason (health, personal etc.) Tearfund are not obliged to refund any donation received. If Tearfund cancels the event, the participant will be entitled to a refund.

d. The Participant can view a copy of Tearfund’s Public Liability Insurance policy on the day of the event, or request a copy beforehand, which states that the Participant is not covered by our insurance policy unless injury or loss is as a direct result of the actions or negligence of Tearfund, its agents or contractors

e. It is the responsibility of the Participant to read through Tearfund's level of cover and determine whether taking additional personal cover is necessary including without limitation, cover for material loss/damage, insurance in respect of any equipment that they may use in the Event, personal property (including clothing), any loss or damage they may cause to a third party, medical expenses, death, injury, repatriation, cancellation and curtailment, or negligence of any part. The Participant must inform their insurer of the type of activity being undertaken.

f. The Participant is responsible for his/her actions whilst participating in the Event.

4. Acceptance of these terms and conditions

By ticking the box on the sign up form, the Participant is legally agreeing to the Terms and Conditions laid out above.

I declare that the information on this form is complete and correct. I understand that I participate in this event entirely at my own risk, that I must rely on my own ability in dealing with all hazards and that I must ride in a manner which is safe for myself and all others.

I am aware that when riding in an event and particularly when riding on a public road, the function of the marshals is only to indicate direction and that I must decide if the movement is safe.

I agree that no liability whatsoever shall be attached to the promoter, promoting organisation, Tearfund, or member of the promoting organisation in respect of any injury, loss or damage suffered by me on or by reason of the event, however caused.

I have read and agreed to these conditions. And have read and agree to the full event conditions.
